Privacy Policy

Your privacy is taken very seriously. This Privacy Policy is written to inform you of what data is collected and how it is used for this application.

By using Swish Counter (“Swish”), you agree to the terms and conditions of this Privacy Policy. Future releases of the application may require modifications or updates. You can see changes on http://swishcounter.com/privacy.html . Your continued use of Swish constitutes your acceptance of this Privacy Policy and any changes or updates to come.

Personal Information

Your use of Swish may cause certain information, including information you may consider personal to you (“Personal Data”), to be stored locally on your mobile phone, tablet, and watch (“Device”). This data includes specific details of the workouts you perform (“Fitness Data”). Your Personal Data and Fitness Data will be treated as confidential and will not be shared with third parties, such as third party service providers and/or advertisers.

Upon installation of Swish on your Device, you may opt to store Fitness Data with Apple's Health App Database (see relevant section below). Personal Data or Fitness Data are only stored locally on your Device. Swish has no intention of releasing your Personal Data and Fitness Data for marketing, advertising, or research use.

Apple Health App Integration

You may opt to integrate Swish with Apple's Health App Database. If you grant Swish access to Apple's Health App Database, Swish will import your data from the Health App Database into the Application in certain circumstances, such as to aid you in the tracking of fitness goals. In addition, Swish may transfer data that you store locally on your Device, such as calories burned and heart rate, to the Health App Database.

Swish cannot read from or write to the Health App Database unless you grant access. Data accessed from the Health App Database will never be shared with third parties, such as third party service providers and/or advertisers.

Swish is in no way responsible for the protection of the Fitness Data and/or other information stored within Apple's Health App Database. You and Apple are solely responsible for the protection of such information in the Health App Database. Please review Apple's applicable policies and procedures before syncing and backing up your Fitness Data and/or other information with the Health App Database.

Security

No Internet transmission is ever completely secure or error-free. In particular, email sent between you and us may not be secure, due, for instance, to the security practices that you, your email carrier, and/or Internet provider employ. You should therefore take special care in deciding what information you send to us via email. Please keep this in mind when disclosing any personal data to us via the Internet.

You are solely responsible for the protection of your Device, including any use of Swish or any storage of Personal Data or Fitness Data incident to the use of Swish on your Device. Please consult your Device's documentation on how to manage local storage and how to apply appropriate security controls to the Device for the protection of information such as passwords. You are entirely responsible for maintaining the confidentiality of your Device password.

Personal Data or Fitness Data that is stored on your Device is your responsibility. In the event that your Device becomes lost or inoperable, your Fitness Data may not be recoverable (see relevant sections above).

Privacy Policy Updates

At times it may be necessary for us to make changes to this Privacy Policy such as due to changes in the services I offer, Apple's policies and procedures and/or the applicable laws of the United States. I reserve the right to update or modify this Privacy Policy at any time without prior notice. Please review this Privacy Policy periodically, especially before you provide any Personal Information or Fitness Data to Swish.

This Privacy Policy was last updated on the date indicated below. Any changes to this Privacy Policy will become effective upon future updates as necessary. As set forth above, your continued use of the Application after any changes or revisions to this Privacy Policy shall indicate your acceptance and agreement with the terms of the revised Privacy Policy.

International Users

Swish is an application developed in the United States and is subject to the applicable state and federal laws of the United States. If you use Swish, you consent to the use and disclosure of information in accordance with this Privacy Policy and subject to such laws.

Health Disclaimer

If you experience faintness, dizziness, pain, or shortness of breath at any time while using Swish, you should stop immediately. I assume no responsibility for injuries incurred while using this application.
